TERMS AND CONDITIONS OF HIRE

FASHION ALTA MODA PTY LTD (ABN 54 635 893 408)

Effective: April 2026

1. INTRODUCTION

These Terms and Conditions govern your use of Fashion Alta Moda's garment hire and subscription services. By placing an order, booking a styling session, or subscribing to a Membership Tier, you agree to these Terms. Fashion Alta Moda Pty Ltd (ABN 54 635 893 408) is referred to as "FAM," "we," "us," or "our."

2. STATUTORY CONSUMER RIGHTS

Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Australian Consumer Law (Competition and Consumer Act 2010 (Cth)).

3. ELIGIBILITY TO HIRE

3.1. You must be 18 years or older to hire garments from FAM. If you are hiring on behalf of someone under 18, you must notify us at the time of booking.

3.2. If you hire on behalf of a company or organisation, you warrant that you are authorised to do so.

4. HIRE TERMS

4.1. Garments may be hired for a standard hire period (4 days unless otherwise agreed).

4.2. Orders must be placed no more than two months in advance.

4.3. Delivery is available to Australian metropolitan areas and other locations as approved by FAM.

4.4. FAM reserves the right to request ID verification before accepting a booking.

 

4.5 Garment images and descriptions

FAM makes reasonable efforts to ensure that garment descriptions, sizing notes, condition notes and images are accurate at the time they are published.

Clients acknowledge that garments may differ from original designer campaign images, runway images, model images or website photographs due to alterations, tailoring, repairs, age, wear, lighting, styling, photography, screen display, body shape, garment positioning or other reasonable variations.

4.6 Alterations and garment variations

Some garments may have been altered from their original designer specifications, including but not limited to hem length, fit, straps, closures, sleeves or internal structure.

Where FAM is aware of a material alteration or significant variation, FAM will endeavour to note this in the garment description or communicate it before hire.

4.7 Online hires / sight-unseen hires

For online hires where a garment is hired sight unseen, the client must notify FAM in writing within 8 hours of receiving the garment if they believe the garment is materially different from the description or images provided by FAM.

The garment must not be worn, damaged, altered, cleaned or have tags removed.

If FAM reasonably agrees that there is a material difference, FAM may offer a refund, credit or alternative remedy in accordance with Australian Consumer Law.

4.8 In-person styling appointments, showroom pickups or try-ons

For in-person styling appointments, showroom pickups or try-ons, the client has the opportunity to inspect, try on and assess the garment before confirming the hire.

Once the client has inspected, accepted and hired the garment, no refund or credit will be issued for change of mind, fit concerns, styling preference, colour variation, alteration, length, or any visible difference that could reasonably have been identified during the appointment, pickup or try-on.

Nothing in this clause excludes, restricts or modifies any rights the client may have under Australian Consumer Law.

 

 

 

 

 

 

 

5. PAYMENT

5.1. Payment for hire is required at the time of booking.

5.2. You must provide a valid credit card and authorise FAM to charge it for all fees related to hire, damages, or breach of agreement. By providing your credit card details, you authorise FAM to charge any outstanding fees including damage, late return, or loss fees following the hire period, without requiring further consent at the time the charge is made.

5.3. If we are unable to process payment, you must make alternate payment arrangements immediately.

5.4. All prices include GST unless otherwise stated.

6. DAMAGE, LOSS OR ALTERATION

 

6.1 You are responsible for the garment from delivery (or collection) until it is returned to and received by FAM.

 

6.2 You must not alter, clean, attempt repairs, lend, or sub-hire the garment.

 

6.3 If the garment is lost, stolen, or damaged beyond repair (as determined by FAM acting reasonably, including having regard to a professional repair assessment where relevant), you agree to pay a loss fee equal to the Replacement Value of the garment, plus reasonable sourcing, restoration, and administrative costs.

 

6.4 If the garment is damaged but repairable, you will be charged the reasonable repair and cleaning costs (including any specialist restoration required).

 

6.5 Damage Assessment Process:

(a) FAM will inspect the garment within 4 business days of return.

(b) If damage is identified, FAM will notify the client in writing with photographic evidence of the damage.

(c) Where damage is disputed by the client, FAM will obtain a written assessment from a qualified third-party repairer or dry cleaner. The cost of this assessment may be included in the damage fee.

(d) The client will have 48 hours to respond to the damage notification before the applicable charge is processed to the credit card provided at booking.

 

6.6 Definitions:

(a) Replacement Value means the amount reasonably required to replace the garment with the same garment, or if that is not available, a substantially similar garment of comparable designer, style, and value. Replacement Value may include (where applicable) sourcing costs, import costs, taxes and duties, shipping, and reasonable administrative costs.

(b) RRP means the recommended retail price in AUD at the time of booking, or if unavailable, the last known RRP evidenced by FAM. RRP may be used as evidence to help determine Replacement Value where replacement is reasonably available.

 

6.7 Any fee charged under this clause is a genuine pre-estimate of FAM's loss and is payable in addition to hire fees. Payment of a loss or damage fee does not transfer ownership of the garment to the client.

 

6.8 Garments must be handled with care. Avoid exposure to cosmetics, tanning products, jewellery snagging, rough surfaces, and overcrowded environments.

7. TITLE AND RISK

 

Ownership of garments remains with FAM at all times. Risk transfers to you upon delivery (or collection) and ends upon FAM's receipt of the return. You must not create any lien or encumbrance over the garment.

 

For clarity, a courier scan or handover to a courier does not mean the garment has been returned unless and until it is received by FAM.

8. RETURNS

 

8.1 Garments must be returned by 5pm on the agreed return date (unless otherwise agreed in writing by FAM).

 

8.2 Late fees: $50 per day for hire values under $500; $100 per day for hire values $500 and above. Charged from the day after the agreed return date until the garment is received by FAM. FAM reserves the right to enforce or waive late fees at its sole discretion on a case-by-case basis. Any waiver does not constitute a waiver of FAM's right to enforce late fees in future.

 

8.3 If a garment is not returned within 7 days of the return date, it is deemed lost and clause 6.3 applies. Late fees may still apply up to the date the garment is deemed lost.

 

8.4 Garments must be returned in original packaging (or equivalent protective packaging approved by FAM).

 

8.5 You must not wear garments for purposes other than those agreed at booking.

 

8.6 If a garment is returned after it has been deemed lost and a loss fee has been charged, FAM may (at its discretion) refund part of the loss fee, less any late fees, cleaning, repair or restoration costs, and reasonable administrative costs.

9. FIT GUARANTEE & CHANGE OF MIND

 

9.1. Online Orders Only:

If a garment does not fit, you must email info@fashionaltamoda.com.au within 8 hours of delivery.

All tags must remain attached for the fit guarantee to apply.

Fit guarantee — one option only:

       Store credit issued, minus a $50 admin fee. No exchanges or refunds.

 

9.2. In-Styling Suite Fittings or Showroom Pickups:

If you try on a garment during a styling appointment or showroom pickup and confirm the hire, no refund or credit is available for change of mind or fit issues.

Once a garment has been picked up, delivered, worn, or used for the selected hire period, it is considered hired.

No refunds or credits will be issued for change of mind, fit issues, event cancellation, personal circumstances, or a decision not to wear the garment after the hire has been confirmed.

Any Styling Appointment Fee is governed separately under clause 11 and remains non-refundable once the styling appointment has taken place.

10. GARMENT HIRE CANCELLATION POLICY

10.1. Cancel more than 7 days before delivery: Store credit issued, minus a $50 admin fee. The $50 admin fee represents a genuine pre-estimate of FAM's administrative costs in processing the cancellation and re-listing the garment.

10.2. Cancel within 7 days: No refund and no credit. Payment is forfeited in full.

10.3. Store credits are valid for 6 months from date of issue. Credits cannot be extended.

10.4. FAM may cancel and fully refund if the garment becomes unavailable.

10.5. Cancellation due to personal circumstances, including illness, event cancellation, change of plans, travel issues, or personal emergencies, is subject to the standard garment hire cancellation policy above. FAM is not responsible for circumstances outside its control.

11. STYLING SERVICES

11.1 Styling Appointment Fee

All Fashion Alta Moda styling appointments are subject to a Styling Appointment Fee, as stated at the time of booking.

Fashion Alta Moda operates by private appointment only and provides access to its curated designer dress hire collection through private styling and try-on appointments.

The Styling Appointment Fee is charged for the appointment time, preparation, access to the styling suite, garment try-on, fit and suitability guidance where required, garment selection support where requested, and one-on-one service provided during the appointment.

The Styling Appointment Fee is separate from any garment hire fee and is not deducted from, credited toward, or applied against the cost of any garment hire.

11.2 Once the Appointment Has Taken Place

Once the styling appointment has taken place, the Styling Appointment Fee is non-refundable.

This applies whether or not the client proceeds with a hire, changes their mind, cancels their event, returns the garment, disputes the hire, or decides not to wear the garment.

11.3 Rescheduling

Clients may reschedule a styling appointment up to 2 hours before the appointment time, subject to availability.

If the appointment is rescheduled in accordance with this clause, the Styling Appointment Fee will be transferred to the revised appointment.

11.4 Cancellations Made 7 or More Days Before the Appointment

If a client cancels a styling appointment 7 or more days before the appointment time, the Styling Appointment Fee may be refunded.

11.5 Cancellations Made Within 7 Days of the Appointment

If a client cancels a styling appointment within 7 days of the appointment, the Styling Appointment Fee is non-refundable.

However, the fee may be held as a credit toward a revised styling appointment with Fashion Alta Moda, subject to availability.

If the client does not have a revised appointment date at the time of cancellation, the credit will be held on file under the client’s name.

Styling appointment credits are valid for 6 months from the original appointment date and cannot be transferred, exchanged for cash, or applied to garment hire fees.

11.6 No-Shows

If a client does not attend a styling appointment and does not reschedule before the appointment time, the Styling Appointment Fee is forfeited.

 

12. FITTINGS

12.1. Fittings are for size and suitability checks only. The garment must not be worn for any other purpose.

12.2. Fitting delivery and return fees must be paid upfront.

12.3. The standard fitting duration is 24 hours unless otherwise agreed.

12.4. FAM reserves the right to refuse fittings during peak periods.

13. GARMENT SECURITY

13.1. If delivered in high-value packaging (e.g., travel case or garment bag), you must not display codes or leave packaging unattended.

13.2. FAM is not liable for loss or damage due to courier issues or failure to comply with packaging instructions.

14. INTELLECTUAL PROPERTY & CONTENT SHARING

14.1. By tagging or sharing content featuring FAM garments, you grant FAM a perpetual, royalty-free licence to use this content for promotional purposes.

14.2. You consent to the use of such content by FAM without need for further permission, except where privacy laws apply.

15. PRIVACY

Your personal information is managed in accordance with our Privacy Policy and the Privacy Act 1988 (Cth).

16. ACCOUNT INFORMATION

16.1. You are responsible for keeping your details accurate and secure.

16.2. You are responsible for all activities under your account.

17. LIMITATION OF LIABILITY

To the maximum extent permitted by law, our liability is limited to the total hire fees paid. We are not responsible for indirect or consequential loss.

18. DISPUTES

You agree to attempt informal resolution of disputes before commencing legal proceedings. FAM will endeavour to respond to all dispute notifications within 5 business days.

19. GOVERNING LAW

These Terms are governed by the laws of New South Wales. Any disputes will be handled in NSW courts.

20. GIFT VOUCHERS

20.1. Valid for 6 months from date of issue.

20.2. Non-refundable and cannot be exchanged for cash.

20.3. Lost or stolen vouchers will not be replaced.

20.4. Vouchers may not be used to purchase additional vouchers.

21. SUBSCRIPTION TERMS

22. UPDATES TO TERMS

We may update these Terms at any time. Continued use of our services means you accept the latest version. We will endeavour to notify clients of significant changes via email.

23. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

24. ENTIRE AGREEMENT

These Terms and any booking confirmation constitute the full agreement between you and FAM, superseding all prior communications.
